I feel like a republican saying this but..

“The Supreme Court has gone too far!”

They really have..

Offices, a riverfront hotel, and a health club are NOT WHAT THE FOUNDING FATHERS MEANT FOR “PUBLIC USE”.

Great. Now they can take away my house because they want to sell the land to a friggen mini-mall for “parking lot expansion”.

Bleah.

UPDATE:

From Justice O’Connor’s own notes:

“Nothing is to prevent the State from replacing any Motel 6 with a Ritz-Carlton, any home with a shopping mall, or any farm with a factory.”

WTF?! That’s not seizing land for PUBLIC USE. That’s seizing land to sell to a PRIVATE COMPANY for PRIVATE USE. That’s bullshit! What the fuck?!

Just made a comment on this in another person’s journal so just copy and pasting:

(summary: Surprised decision passed. Good: Overall city income increases, overall city unemployment and poverty levels decrease, city looks more beautiful, and city is able to maintain public facilities more adequately. Bad: Personal loss, family losses. Families devastated.)

Reading the article, I’m not surprised it was a close vote but I’m surprised it actually passed.

The problem is that greed will become a factor here and corruption potential high. The good that this decision will accomplish will also probably be negated in the future by the wealthy. (potentially)

Economically, it increases a lot of potential jobs and development to the city that might have otherwise wasted away. Something like what they proposed probably will decrease unemployment, increase city revenues, decrease poverty.

Cost is rather high though as personal property is such a precious thing that money can’t replace… plus who knows if the disposed will be able to buy proper housing for themselves or even know how to budget the money so that it lasts and benefits them for years to come.

it’s not so much the specific case that bothers me, but what this opens up in this country.

look up California’s Proposition 13. mesh the two together, and we have a serious problem.

I’m corporate mogul, and I want to build a building to house 1500 jobs, and I want to build it where these 4 houses are. Thanks to tax limits proposed by prop 13, the city pays the tax at the time of the house’s current owner purchased the house. Then the city sells it to me for the current, higher tax rate. Everybody but the homeowner wins. Now they have to find a house and are going to have to pay a higher tax rate on it.

That’s just california, other states will probably have similar laws on the books soon, if they don’t already.

Now your property can be taken away if its “for the common good”, not just for public use.

“We don’t like you in our neighborhood, so we’ve petitioned the city to sell us your house.”

This is horrible, and can only get worse.

Be a Libertarian! You get to say shit like that and not feel like an evil Republican! =D

I can’t. Some of their past choices for elections left a bad taste in my mouth.

Yes, I was a member of the party once, I’ve just decided there are some things I *can’t* agree with. In the Democrat party, I have to deal with ultra-liberals and even some ultra-conservatives, but I don’t feel like I have to agree with their stances to be heard. :)
Now, that’s NOT saying I can’t be friends with Libertarians, it’s just a few that I felt I couldn’t associate with. At all.

Oh yeah. Totally agree. That’s why I’m surprised it passed and I’m surprised they didn’t take into account the negatives of potential corruption to the system.

Saw this other day and was like WTF myself. While it set us some potental for bad things in the future the real test is going to be when the next case comes in for what is considered ‘public good’ Is that new strip mall for the public good, is a parking lot for the public good. It leaves alot open to interpitation much like porography it seems. I forsee several follow up cases reaching them in next few years.

the problem is that it’s already been abused for what amounts to a strip mall, in this very case..

huh?

I never got a response back from her when I posted a comment on her LJ.. I had no way to contact her.

As far as I could tell, she wasn’t interested in meeting up while I was in dallas.

I am, however, worried.. Keep me posted if you hear from her?
